Privacy by Design: a matter of trust for the consumer

To better understand consumer expectations, Data On Duty conducted a study of 200 companies and more than 1,000 people, all age groups and socio-professional categories combined. 

72% of the people surveyed say they can give their consent if the data collected is processed in compliance with regulations and their privacy. This emerging need implies reconsidering the design of digital applications by integrating a Privacy by Design process at all stages of development.

What is Privacy by Design?

The principle ofPrivacy by Design requires developers to consider data protection, data storage and data transport at the design stage of an application. This is true throughout the development of products, processes or services involving the processing of personal data. Similarly, default settings on the nature and amount of personal data collected must be privacy-friendly.

At Data On Duty, Privacy by Design is based on automated rules (from design to production) and shared by all active stakeholders (DPO, CDO, IT, agencies, etc.).

Privacy by Design: proactive or reactive?

Massive rejection of consent or ignoring it impacts users and the business. 

  • The former will be subjected to an avalanche of untargeted ads and poor screen exploitation. 
  • The company will have a consequent loss in consumer data collection causing poor exploitation of content, advertising space and increased campaign costs.

User experience and data protection imply a new approach where GDPR and ePrivacy become engaging ethical business differentiators. Privacy becomes a non-negotiable notion and not just the result of a regulation.

Privacy by Design allows for the integration of user experience and data protection at the design stage by testing functionality, tagging, cookies and privacy.

Focus on proactive correction

Privacy by Design is a proactive approach focused on privacy protection. Its goal: to reduce the risk of rule violations of General Data Protection Regulation (GDPR) and damage to ePrivacy.

Proactive correction therefore begins at the development stage, by respecting all the good practices necessary for the GDPR compliance and ePrivacy: 
  • tagging on activation,
  • cookie setting,
  • storage,
  • data encryption,
  • data transport, 
  • third-party requests.
A series of audits is performed at each phase of the development process to identify errors and apply the necessary corrections. The corrections made before the release of the software allow us to deliver a clean and compliant version.

How to become a Data Responsible ?

Data responsability is the goal we need to focus on to increase visitor consent and improve data collection.

This type of strategy begins when the visitor arrives on the site. If the user's only choice is toaccept, set up, refuse orignore consent, this implies ignoring consumers' expectations. Consumers need a simple grid to know if the company is respectful of their data and to feel confident while browsing.

What about the user at the center?

Being Data-Responsible means making a commitment to consumers and to the company. It means keeping users' privacy interests in mind and providing the necessary safeguards and features to protect their interests. 

Right from the design of a site or an application, privacy anduser experienceconcepts must be integrated. The goal is to restore consumer trust and increase consent. It is also a way to improve the company's competitiveness by establishing transparent communication to restore the relational balance with consumers.

Each company must therefore determine the degree of transparency it wishes to offer its consumer in the context of data processing. It must also specify the amount of data it wishes to collect about data subjects.

Privacy by Design: what is at stake for companies?

Privacy by Design is essential in order to protect personal data and the right to privacy of users. However, due to the rapid evolution and the multiplicity of actors involved in the design of applications, digital environments are complicated to master.

Privacy by Design will be integrated into the development processes to :

  • ensure privacy, 
  • give users a better experience,
  • provide consumers with a better understanding of the use of personal data through a trust index.

Web users want to protect their privacy and personal data, which will make application design increasingly complex. Fortunately, Privacy by Design will facilitate this compliance and respect for the privacy of visitors.
